Trump said hopped on a report that put the tab for the investigation led by Robert Mueller that he called the'Russian hoax at $17 million

U.S. President Donald Trump's attorney Rudy Giuliani said on Sunday the president probably has the power to pardon himself but does not plan to do so.

They also argue that Trump can not be accused of obstructing justice because he has the constitutional power to end the investigation led by the Justice Department.

Giuliani says they would contest it if Mueller tried.

The memo, with a letterhead in Comic Sans font, is dated January 29 and was obtained by The New York Times on Saturday.

"I think you're gonna have a very positive result in the end, not from one meeting", Trump said.

Trump has spent months attacking Mueller, who has been leading the Russian Federation investigation since May 2017 after the president terminated FBI Director James Comey. The never-before-seen memo makes a broad case for the executive autonomy of the commander-in-chief, as the president's lawyers argue a sitting president can not be subpoenaed.

Earlier this month, Trump attacked the investigators, tweeting that the special counsel team is "composed of 13 Angry and Heavily Conflicted Democrats and two people who have worked for Obama for 8 years, STOP!"

Trump tweeted 40 minutes before the New York Times broke the news, questioning whether Mueller's team or the Department of Justice was responsible for leaking the letter.

Although Giuliani was not on the legal team at the time, he confirmed the contents of the letter to ABC News.

"The appointment of the Special Councel [sic] is totally UNCONSTITUTIONAL!" wrote Trump on Twitter.

The letter does not stress legal opinions by the Justice Department in the Nixon and Clinton administrations that held that a sitting president can not be indicted, in part because it would impede his ability to carry out his constitutional responsibilities.

The Supreme Court, for instance, has never definitively ruled on the question of whether a president can be forced to testify, though the justices in 1974 did rule that Richard Nixon had to produce recordings and documents that had been subpoenaed.

"The fact that Trump felt compelled to weigh in on the ongoing legal debate over whether or not he can pardon himself (as well as whether or not Mueller can subpoena him or indict him) means the idea that there may eventually be something to pardon himself for is on his mind".

The FBI began a counterintelligence investigation in July 2016 to determine whether Trump campaign associates coordinated with Russian Federation to tip the election.

The letter did not explicitly describe the possibility of Trump pardoning himself.

Nearly immediately, Trump took a dig at special counsel and the Justice Department.

Topics of Mueller's obstruction investigation include the firings of FBI director James Comey and former national security adviser Michael Flynn, as well as Trump's reaction to Attorney General Jeff Sessions' recusal from the Russian Federation investigation. Giuliani has said that the president's legal team believes the special counsel does not have the authority to do so. The response came from Donald Trump Jr. and -- I'm sure -- in consultation with his lawyer.
