Man in deadly 'stand your ground' shooting won't face charges police

McGlockton, who was in the store with his 5-year-old son, exited the store, walked to Drejka and pushed him down to the ground. "This was a violent push".

Drejka, who is white, told local police he shot McGlockton, who is black, out of fear for his life.

A Florida sheriff says he will not arrest a man who killed a man during an argument over a parking space. He said he saw Drejka walking around his vehicle checking to see if he had a permit, which he didn't.

Slate reports that Gualtieri made sure to emphasize the power of the shove, as if to justify Drejka's actions. The State Attorney General could still make an arrest. Video surveillance captures Drejka firing his pistol and striking McGlockton in the chest.

Surveillance video provided to FOX 13 News by the store's owner, Ali Salous, shows the alleged altercation.

At the time of the shooting, the dead man's girlfriend, Brittany Jacobs, 24, was sitting in her auto in the disabled spot outside a convenience store. The law used to be that the defendant had to raise stand your ground as a defense and the defendant had the burden of proving that they were entitled to immunity under Stand Your Ground. Jacobs watched her boyfriend get shot with their 4-month-old and 3-year-old children.

Jacobs told WFTS that Drejka was getting away with murder.

Bob Gualtieri, the Pinellas County sheriff, insisted he has to follow the "stand your ground" law, which dictates that if a person feels threatened they have the right to shoot.

McGlockton stumbled back into the store and collapsed, dying from the gunshot wound as his 5-year-old son looked on and as Jacobs tried to apply pressure to the wound and stop the bleeding. Rich Kelly says the man picked a fight with him over a parking spot, using racial slurs, and even threatening to kill him.

As the drivers remonstrated, a witness entered the store and informed the clerk that there was a disturbance outside, police said. "It happened to me the first time". He says prosecutors could still charge the shooter but Gualtieri's comments might make that hard.

"What's relevant is not whether this guy's a good guy, nice guy, or whether he's a jerk, or whether he's a thorn in people's side and what he's done, whether it's three weeks ago, three months ago or three years ago", Gualtieri said.
