Homeless Good Samaritan Suing Couple Who Raised $400K To Help Him

Homeless man suing couple who raised $400,000 to help him

A grateful McClure and her husband, Mark D'Amico, set up an online fundraising page publicising Bobbitt's good deed and inviting wellwishers to donate to help him get off the streets.

In addition, McClure and D'Amico let Bobbitt live with them for several months, during which time he invited his brother, who allegedly is also addicted to drugs, and "half a dozen homeless people" to stay there with him two when the couple was not at home, Badway said.

The judge ordered D'Amico and McClure to transfer the remaining money into an escrow account by the end of business on Friday and hire a forensic accountant to review the financial records within 10 days. He's seeking undisclosed damages, and his lawyers want a judge to appoint someone to oversee the account.

Johnny Bobbitt became a viral sensation in October a year ago when he used his last $20 to buy petrol for Kate McClure, who was stranded after running out of fuel on a motorway exit ramp near Philadelphia.

But the veteran soon accused the couple of withholding some of the more than $400,000 the campaign raised.

Bobbit had gained worldwide attention after he spent his last $20 to help a McClure buy gas last fall.

Homeless veteran Johnny Bobbitt is pictured on November 25, 2017 during an interview with "Good Morning America". However, in an more recent interview with Megyn Kelly on the American TODAY Show, he said it was roughly $AU200,000.

But, their relationship soured when Bobbitt insisted that the couple had not handed over all the cash raised for him.

Bobbitt's pro bono lawyers filed a complaint on Tuesday alleging that McClure and D'Amico have misused the funds and spent a substantial amount of the money for themselves.

McClure said on the GoFundMe page that the money would be used to buy Bobbitt a house and truck, and the rest would be placed in two trusts-one that would let him "collect a small "salary" each year" and another for his retirement. That's why they took them to court, according to Bobbitt's lawyer Christopher C. Fallon.

They are now preparing the accounting that will "show where the money went", Badway said.

Jacqueline Promislo, an attorney for Bobbitt, said by email that she's "very concerned" that much of the money will be gone by the time it's accounted for. Appearing on television this week, D'Amico told Kelly: "Every dollar [Bobbitt] ever touched was used for drugs".

Bobbitt told the Philadelphia Inquirer that begging for money on the streets was easier than trying to get his GoFundMe donations from McClure and D'Amico.

McClure and D'Amico did not attend the hearing, but the Florence Township couple were represented by attorney Ernest E. Badway.
