Judge throws out Stormy Daniels' lawsuit against Trump

Judge dismisses Stormy Daniels' defamation suit against Trump orders her to pay president's legal fees

A federal judge in Los Angeles on Monday threw out the defamation lawsuit and ordered Daniels to pay the president's legal fees. "We will appeal the dismissal of the defamation cause of action and are confident in a reversal", he tweeted.

Daniels' attorney, Michael Avenatti, responded to the ruling on Twitter and said: "Daniels' other claims against Trump and Cohen proceed unaffected".

The ruling does not affect a separate lawsuit the actress has filed against the president over money she says she was paid by Mr Trump's lawyer, Michael Cohen, to keep quiet about the alleged affair.

A judge in the USA has rejected a defamation lawsuit brought by adult film star Stormy Daniels against President Donald Trump, and ordered her to pay his legal fees.

In Monday's decision from S James Otero, a federal judge in the central district of California, it was found that "Mr Trump's statement constituted "rhetorical hyperbole" that is protected by the first amendment". "The First Amendment protects this kind of rhetorical statement", the judge wrote in his verdict.

Trump has denied having an affair with Daniels. Daniels said the man approached her and her young daughter in 2011 after she had agreed to tell her story about the alleged tryst to a tabloid magazine.

"The amount of the award for President Trump's attorneys' fees will be determined at a later date", Harder added.

"Mr. Trump used his national and worldwide audience of millions of people to make a false factual statement to denigrate and attack Ms. Clifford", the federal court complaint said at the time.

Ms Daniels then released a sketch of the man.

She said Trump's tweets made her look like a liar.

"You are a disgusting misogynist and an embarrassment to the United States", Avenatti tweeted.

The amount Ms Daniels will have to pay Mr Trump has not yet been decided, Charles Harder, the president's lawyer, said.

Trump, who has claimed "nobody has more respect for women" than he does, has repeatedly mocked women's appearances. In a March interview with CBS's "60 Minutes", said she met Trump at a July 2006 golf tournament and had consensual sex with him in his hotel suite. A total con job, playing the Fake News Media for Fools (but they know it)!"the president tweeted".
