Federal judge bars United States administration from enforcing ban on asylum

Trump fires back at federal judge’s ruling on immigration in scathing statement

DHS estimates around 70,000 people a year claim asylum after crossing illegally.

As Trump has made abundantly clear, he's terrified of the slow-moving migrant caravan.

However, Tigar's ruling was in line with current U.S. immigration law, which allows anyone to seek asylum even if they enter the country illegally.

"The administration has overriden that unilaterally".

Earlier this month, the President issued a proclamation referring to "large, organized groups" who were traveling through Mexico and "reportedly intend to enter the United States unlawfully or without proper documentation and to seek asylum".

US District Judge Jon Tigar in San Francisco issued on Monday night a temporary restraining order against the Trump proclamation, thus granting a request from human rights groups who had sued shortly after the order was announced.

'As the Supreme Court affirmed this summer, Congress has given the President broad authority to limit or even stop the entry of aliens into this country, ' the Justice Department and the Department of Homeland Security said in a joint statement.

"There is no justifiable reason to flatly deny people the right to apply for asylum, and we can not send them back to danger based on the manner of their entry", he said.

But during the court hearing Monday, Tigar, an Obama appointee, appeared skeptical.

Torrez said he fled Nicaragua after someone threw acid at him during a government protest.

The Trump administration on Tuesday called the asylum system "broken" and "abused by tens of thousands of meritless claims every year". The administration introduced the policy earlier this month.

Trump has tangled with the ninth court before - and won.

They are not allowed to detain illegal crossers.

But their access to it will still depend on the discretion of an administration that is on the record, and in court, arguing that they shouldn't be allowed to apply for it. From San Francisco, NPR's Richard Gonzales reports. He reasoned that the "interpretive guide" of United Nations compacts on asylum lent extra force to congressional requirements.

It's possible that some people were simply deported because they mistakenly thought it wouldn't matter if they expressed any fear of persecution in their home countries - or that they tried to seek asylum but were rebuffed by immigration officers failing to follow the directions set down in the new policy.

The challenge to the asylum ban was brought by the American Civil Liberties Union and other advocacy groups on behalf of East Bay Sanctuary Covenant. They argue that the administration didn't give the public a chance to comment on the new rule.

"We are looking very carefully at what the judge has ruled and we will comply with it", she said. Gelernt said he believes they also have third party standing for children being denied applications for entry at ports of entry in Mexico unless they have a guardian. It raises serious concerns about separation of powers against the backdrop of an enormous humanitarian crisis where people are going to be sent back to be persecuted, possibly killed.

Gelernt said the ACLU had recently learned Mexican authorities have begun barring unaccompanied minors from applying at US ports of entry. But it can't control how individual asylum officers evaluate the screening interviews of individual asylum-seekers - or what individual border and detention officers say to asylum-seekers about what their rights are.

A federal court temporarily blocked the Trump administration's new asylum ban. Under a directive from former Attorney General Jeff Sessions, those are no longer grounds for seeking asylum in most cases.
