Ruther Bader Ginsburg to miss second week on Supreme Court

The political world is abuzz with rumors that Justice Ruth Bader Ginsburg may soon resign from the U.S. Supreme Court, potentially sparking the most intense fight yet over President Donald Trump's third nominee to the nation's highest court.

Ginsburg will continue to work from home next week, but she will participate through briefs and transcripts. She missed oral arguments for the first time in more than 25 years last week.

Court spokeswoman Kathy Arberg says that doctors for Ginsburg confirmed an initial evaluation that found no evidence of remaining cancer following surgery. She underwent surgery on December 21 to remove two cancerous growths from her left lung.

Politico said numerous prospective nominees to replace Ginsburg were women, which theoretically would derail the likelihood of sexual-assault claims such as those faced by Justices Thomas and Kavanaugh.

Ginsburg, who will turn 86 in March, is recuperating at her Washington, DC, home. The justices will next be on the bench on February 19, when they are due to hear a contentious case arising from President Donald Trump's administration's decision to include a citizenship question in the 2020 census. In 2013, she told the New York Times, "As long as I can do the job full steam, and that, at my age, is not predictable". She had scheduled the treatments for both so she wouldn't miss oral arguments.

During the 2016 presidential campaign, Ginsburg slammed Trump and called him a "faker", an unusual move for a Supreme Court justice.

"Roe, I believe, would have been more acceptable as a judicial decision if it had not gone beyond a ruling on the extreme statute before the court", she wrote in the North Carolina Law Review.

If Ginsburg, who was appointed to the Supreme Court by former President Bill Clinton, were to vacate her seat, Trump would have the opportunity to give the Court its largest conservative majority in decades. It's been just under three weeks since the Notorious RBG went under the knife, so while she's theoretically still got a little more recovery time, the odds are that this beloved workaholic will be back on the bench before you know it. The key liberal justice returned to the court shortly after the fall that fractured three of her ribs last November. This marked Ginsburg's third bout with cancer.
