An Alabama judge has let a wrongful death lawsuit proceed in which a father is suing an abortion clinic on behalf of his aborted unborn child.

Magers claims in court papers that his ex-girlfriend took a pill to end her pregnancy on February 12, 2017 despite his pleas to keep the baby.

"Roe vs. Wade and Planned Parenthood vs. Casey says that a woman has a right, a privacy right, under the due process clause of the 14 amendment, to have an abortion", he said.

On Tuesday, an Alabama county court recognized the aborted fetus, "Baby Roe", as a plaintiff in the lawsuit, making the case one of the first of its kind, his lawyer said.

The lawsuit follows a state constitutional amendment approved in November during the 2018 midterm election cycle by 59 percent of Alabamians, which made it Alabama state policy to "ensure the protection of the rights of the unborn child" and "recognize and support the sanctity of unborn life and the rights of the unborn children, including the right to life".

"It's the first time in the country that an aborted foetus has been recognised as having legal rights", Brent Helms, Mr. Magers' attorney, told local news outlet WHNT 19.

"The only thing that estate has is the right to sue, and so that is what Ryan is doing - is suing on behalf of Baby Roe's estate", Helms said.

Magers is demanding a jury trial.

"We don't know from generation to generation what the composition of the Alabama Supreme Court is going to be", Fridy said.

"I'm here for the men who actually want to have their baby", he said.

The attorney said the State of Alabama recognizes life beginning with conception, and this case could put that law to the test.

The memorandum, as quoted by Helms and available to the public, says, "during the first trimester of pregnancy, Baby Roe's mother aborted Baby Roe".

Many experts anticipate that the "Baby Roe" case will eventually find its way up to the Supreme Court.

Hannah Ford, spokeswoman for Personhood Alabama, said the lawsuit stands in stark contrast to a new NY law and a proposed Virginia law that support abortion up to the moment of birth. The pro-life advocacy group praised the filing in a blog post at the time, calling the lawsuit a "timely reminder that every single abortion committed is a chilling assault on a precious and innocent human life".

NARAL Pro-Choice America President Ilyse Hogue called the case "very scary", saying it is "asserting woman's rights third in line".

Huntsville-based Alabama Women's Centre for Reproductive Alternatives and an unknown pharmaceutical company that manufactures pills "designed to kill unborn children" were named as defendants.

The women's center has until April 1 to respond to the suit, according to Fox News.
